1. Acceptance of Terms

By downloading, installing, or using the Zivanai mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not access or use the App. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years old to create an account on Zivanai. By registering, you confirm that you are at least 18, that you are legally permitted to use dating services in your jurisdiction, and that you are capable of forming a binding contract under the laws of the Republic of Zimbabwe. Users self-declare their age during profile creation. If we discover that a user is under 18, their account will be immediately terminated.

3. Account Registration & Security

You must provide a valid email address or phone number to register and complete verification via a one-time code (OTP). OTP codes are sent by email or WhatsApp depending on your registration method. You are responsible for keeping your login credentials secure. You must not share your account or allow others to access it. Zivanai is not liable for any loss arising from unauthorized use of your account. Each person may only maintain one active account.

4. User Conduct & Community Guidelines

You agree to use Zivanai respectfully and lawfully. The following are strictly prohibited and may result in immediate suspension or permanent ban:

Violations may be reported by other users. Zivanai reserves the right to take action including warnings, temporary suspension, or permanent account termination without prior notice.

5. Profile & Content

You retain ownership of photos, text, and audio content you upload. By uploading content, you grant Zivanai a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content solely for the purpose of operating and promoting the App. Profile photos are stored on secure servers and are only visible to users within the App. You may delete your content at any time by editing your profile or deleting your account.

Content Moderation: To maintain community safety, Zivanai uses automated moderation. Messages may be filtered for prohibited language, bios may have URLs or phone numbers removed, and photos are scanned using AI to detect explicit content. Content that violates our guidelines may be modified or rejected. By using the App, you acknowledge and consent to this automated moderation.

6. Premium Subscription & Payments

Zivanai offers three tiers:

New accounts receive a complimentary 3-month premium trial. When the trial ends, your account automatically reverts to the Free tier unless you subscribe. To prevent trial abuse, a one-way hash of your email or phone is retained after account deletion; this hash cannot be used to recover your identity.

Payments are processed via EcoCash mobile money or other available payment methods as displayed in the App. Subscriptions auto-renew unless cancelled before the renewal date.

7. Matching, Messaging & Interactions

Zivanai facilitates introductions between users through its matching algorithm. Mutual likes create matches that enable messaging. Messages may include text, voice notes, images, and GIFs.

Super Likes & Message Requests: Users may send super likes with an optional message to express interest before matching. Recipients can accept or decline these message requests. Monthly limits apply based on your subscription tier.

Photo Likes: Users can like specific photos on profiles. Photo likes are visible to the profile owner.

Profile Boost: Premium users can boost their profile for increased visibility in discovery. Boosts are limited to 3 per week and last for a set duration.

Read Receipts: Premium subscribers can see when their messages have been read.

Zivanai does not guarantee any specific outcomes, matches, or relationships. You interact with other users at your own risk and should exercise caution when meeting in person.

8. Privacy & Contact Stealth

Zivanai offers a Contact Stealth Mode that allows you to block people in your phone contacts from seeing your profile. This feature uses salted and hashed phone numbers to protect your privacy — Zivanai does not store your contacts in plain text. You can choose to block all contacts, specific contacts, or allow only certain contacts to see you.

Location Privacy: Premium users can block specific locations from seeing their profile and hide their location from other users. The Passport feature allows you to set your discovery location to a different city.

9. Push Notifications

By enabling notifications, you consent to receive push notifications about matches, messages, likes, message requests, and other App activity. You can disable notifications at any time through your device settings or within the App.

10. Account Termination & Deletion

You may pause your account to temporarily hide from discovery while retaining your matches and messages. While paused, your profile is invisible to other users but all your data is preserved.

You may permanently delete your account at any time from the Profile section. Account deletion is irreversible and will permanently remove your profile, photos, matches, and messages. Zivanai may also terminate accounts that violate these Terms.

11. Disclaimer of Warranties

Zivanai is provided "as is" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure. Zivanai does not conduct criminal background checks on its users. You are solely responsible for your interactions with other users.

12. Limitation of Liability

To the maximum extent permitted by Zimbabwean law, Zivanai shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App, including damages resulting from interactions with other users, loss of data, or unauthorized access to your account.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Zimbabwe. Any disputes arising from these Terms or your use of the App shall be resolved through mediation first, and if unresolved, through the courts of Zimbabwe. The Cyber and Data Protection Act (Chapter 12:07) and the Consumer Protection Act apply to this agreement where relevant.
